A fresh legal battle has emerged over the conviction of IPOB leader Nnamdi Kanu, as his special counsel, Aloy Ejimakor, urged the Court of Appeal to overturn the judgment.

He argued that the trial became flawed when Kanu was allowed to conduct his own defence despite facing charges carrying severe penalties.

Ejimakor maintained that once Kanu’s legal team stepped aside during the trial, the court should have appointed another lawyer to represent him.

He said Nigerian law requires legal representation in cases that could result in life imprisonment or the death penalty, regardless of a defendant’s personal preference.
According to the lawyer, the trial court failed to follow provisions of the Administration of Criminal Justice Act, which he said makes legal representation compulsory in such cases.
He also cited previous Supreme Court decisions that treated the absence of counsel in capital trials as a serious legal defect.
The appeal, he argued, could determine the fate of Kanu’s conviction.
Ejimakor insisted that allowing the IPOB leader to defend himself may have undermined the fairness of the proceedings and could provide grounds for the appellate court to set aside the verdict.
