Former Kogi West senator Dino Melaye has notified the National Assembly of his plan to challenge parts of Nigeria’s new tax laws that deal with Value Added Tax, raising questions over their constitutionality.

The move targets provisions in the Nigeria Tax Act 2025 and the Nigeria Tax Administration Act 2025, which give the Federal Government powers to impose, manage, collect, and share VAT across the country.

Melaye’s notice was formally sent to the Clerk of the National Assembly, Kamoru Ogunlana, through his legal representatives, serving as a pre-action step required by law before filing a suit.

He argues that VAT is not listed under either the Exclusive or Concurrent Legislative Lists in the 1999 Constitution, meaning it falls under matters reserved for state governments rather than the federal authorities.
Based on this, he insists that the VAT sections of the new tax laws conflict with the Constitution and are therefore invalid, claiming they overstep the lawmaking powers of the National Assembly.
Melaye has given the lawmakers three months from the date of the notice to suspend and repeal the VAT provisions, warning that failure to do so will lead him to seek redress in court as a taxpayer.
