BREAKING: Fayemi wins eligibility suit as court dismisses Oni’s case

An Ado Ekiti Federal High Court today, dismissed the suit filed by a former governor, Segun Oni, challenging the eligibility of Governor Kayode Fayemi who contested and won the All Progressives Congress (APC) governorship primaries as a sitting minister.

Justice Uche Agomo said in her judgment that Fayemi, who was a minister as the time he contested and won the APC ticket was not to be in the categories of persons referred to as a public officer being a Minister.

The judge said he can only be solely referred to as public servant by Code of Conduct Bureau.

Justice Agomo also ruled that the White Paper on reports of the panel of inquiry was not a charge and same cannot be read to be so.

She ruled further that INEC had no powers to reject candidate submitted the commission

“The claimant’s action lacks merit as same frivolous and is hereby dismissed,” the judge ruled.

Earlier, the court had dismissed the preliminary objections filed by Fayemi and the APC, holding that “an Aspirant has a locus standi to challenge any breach of party constitution and guidelines.”
