Obaship Tussle: Fayemi Allegedly Ordered Detention Of 100 Year-Old Man Despite Court Order Discharging Him
Controversy is now raging in Ekiti State over the refusal of the police to release a 100 year-old man, Michael Ogundele, despite order of an Ado Ekiti Magistrate Court, discharging him.

On July 20, 2020, Form K was invoked on Ogundele by the Magistrate Court, which ordered that he be remanded in police custody owing to Obaship tussle in Iloro Ekiti, Ijero Local Government area of Ekiti State.

Ogundele was said to have led opposition against the emergence of Oba James Olugbesoye as the Oluloro of Iloro Ekiti.

The 100 year-old man was accused of snatching gun from a Civil Defence officer and that he attempted to kill the officer.
However, the monarch settled with his opponents and a memorandum of settlement was presented to the court today.

Consequently, a motion on notice was filed on behalf of the accused by Kola Kolade urging “the court to release Ogundele from police custody in view of the peace meeting and the amicable settlement between the applicant and the nominal complainant in Form K dated 20th July 2020.”
Oluwaseun Olasanmi, a senior legal officer from the Ekiti State Ministry of Justice, who represented the State Government did not object to the application due to instructions of the State Attorney General and Commissioner for Justice, Wale Fapohunda (SAN).
In his ruling, Magistrate A. O. Oyebanji ordered that “all parties involved are hereby bond to maintain peace with one another and with the whole Iloro Ekiti community without any rancour or acrimony any longer.
“In view thereof, the substantive case i.e MAD/95FK/2020 in the case of COP vs Ogundele Michael is hereby struck out and the defendant hereby discharged but not on the merit.”
However, when the court order was taken to the police to effect the release of 100 year-old Ogundele, the police refused to release him, claiming that Governor Fayemi’s Chief Security Officer (CSO), Mr Adeyanju had directed that the governor said he (Ogundele) must not be released.
