The court held that the position of a Vice President is not a necessary party in an election petition, that he is an appendage to the Candidate and he rises and fall with the candidate.

The tribunal Chairman, Garba Mohammed, addresses the court: “You recall that the court had noted after the final addresses were taken that it will give a date for the final decision. That date is today.
Citing section 178 of the constitution, Garba said there was no need for Osinbajo to be joined in the matter. “The vice-president was nominated by the presidential candidate,” the lead justice adds.
