Kanu Files Criminal Complaint Against Top Officials Over False Testimony

Nnamdi Kanu has moved to prosecute the Attorney General of the Federation, the Director-General of the DSS and two prosecution witnesses, accusing them of giving false evidence in his ongoing terrorism trial.

He filed the complaint on 13 November 2025 at an FCT Chief Magistrate Court in Abuja, ahead of the judgment in his Federal High Court case set for 20 November.

The action was announced in a statement from the Mazi Nnamdi Kanu Global Defence Consortium, issued by Njoku Jude Njoku. The filing lists two prosecution witnesses, identified as Mr TAA and Mr BBB. It was personally signed by Kanu from DSS custody, alleging perjury, subornation of perjury and conspiracy to obstruct justice.

Kanu’s complaint centres on claims that the first witness denied knowing DSS officer Brown Ekwoaba, who Kanu says oversaw his detention, interrogations and torture in 2015. The exhibits include affidavits from Prince Emmanuel Kanu and Benjamin Madubugwu, along with DSS documents said to confirm Ekwoaba’s postings between 2015 and 2020.

He also accused the second witness of giving false evidence by claiming to have never met him before the court appearance, despite allegedly leading a recorded interrogation on 17 July 2021. Court records referenced in the filing are said to contradict the witness’s testimony. Kanu further noted that both witnesses appeared in court masked, which he argues was meant to conceal their earlier roles in his interrogations and the handling of evidence.

The IPOB leader also levelled accusations against the AGF’s team for bringing in what he called “surprise witnesses”, relying on statements he says were obtained under torture and resisting calls to identify the officers involved in questioning him. The DSS DG was accused of supporting coached testimony and blocking evidence that could favour his defence.

Kanu’s filing argues that the actions of the officials and witnesses breach the Penal Code, the Administration of Criminal Justice Act 2015 and constitutional guarantees on fair hearing, protection from torture and the right to cross-examine witnesses. He is asking the court to punish all four accused individuals for perjury and conspiracy and to recognise that the prosecution’s case was built on coerced and fabricated evidence.

His legal team said this is the first instance in Nigeria where a detainee in DSS custody has initiated criminal proceedings against high-ranking state officials, including the AGF and DSS DG, using documentation to allege coordinated false testimony. They said the complaint reflects a broader pattern of witnesses they believe were prepared and presented in court to support charges not backed by lawful evidence.
