The bid by Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, to secure a transfer to the National Hospital for urgent medical treatment has been delayed as his application has been referred back for reassignment.

At the Federal High Court in Abuja on Monday, Justice Musa Liman ruled that the motion filed by Kanu’s legal team could no longer be handled within the vacation period and must be sent to the Chief Judge for reassignment. The decision came after Kanu’s counsel, Uchenna Njoku, sought an adjournment, citing the late service of a counter affidavit by the Department of State Services.

The DSS, represented by Chief Adegboyega Awomolo, did not oppose the request but noted that the case was filed late into the court’s vacation schedule. Justice Liman explained that under the court’s rules, any case not concluded within the vacation must be returned for reassignment, even though Kanu’s application was described as urgent due to his health condition.

Kanu, through his lawyers led by Chief Kanu Agabi, had earlier filed a motion seeking to be moved from DSS custody to the National Hospital. The request was backed by medical reports indicating declining health, including issues with his pancreas, liver, a lump under his armpit, and dangerously low potassium levels. His doctors had also written to the DSS recommending his transfer, but the letter reportedly went unanswered.
The case, with charge number FHC/ABJ/CR/383/2015, forms part of Kanu’s ongoing trial before Justice James Omotosho on terrorism-related charges. His bail application, filed in May, has also not been decided.
With the vacation now over, the case file will return to the Chief Judge of the Federal High Court for reassignment to a regular court for further hearing.
