Nnamdi Kanu’s request to be moved from Sokoto prison returned to court after he filed a fresh motion asking to be kept in a facility closer to Abuja so he can pursue his appeal.

The application was taken to the trial court by his brother, Emmanuel Kanu, who said the IPOB leader could not appear in person and asked the judge to hear the motion in his absence.

Things changed when the case was called and the judge refused to let Emmanuel address the court. Justice James Omotosho ruled that only a certified lawyer can move such an application, stressing that Emmanuel lacked the legal standing to speak for a defendant in a criminal matter.

The judge explained that representation in court must come from a legal practitioner, not a family member. He noted that only a trained lawyer, called to the Nigerian Bar, is allowed to argue motions on behalf of an individual. He advised the applicant to hire a lawyer or seek help from the Legal Aid Council, which is permitted to offer representation.
He further stated that Emmanuel would need years of legal training before he could qualify to appear in court as a lawyer and therefore could not be allowed to move the motion.
After receiving the judge’s guidance, Emmanuel asked for a new date to return with proper legal counsel. Justice Omotosho then adjourned the matter to December 8.
